Please note that by using this website you are accepting all these terms and conditions; if you do not agree with anything in this notice you should not use this website.

5.1 If any of these Terms & Conditions is declared invalid, unlawful or unenforceable, then that provision shall be deemed to be deleted from these Terms & Conditions and the remaining provisions shall remain in full force and effect.
5.2 We have the right to revise and amend these Terms & Conditions from time to time without prior notice by changing them on the Site, provided that any such change will not affect any purchases you have made before the change is implemented.
5.3 Failure by us to enforce a right does not result in waiver of such right. You may not assign or transfer your rights under these Terms & Conditions.
5.4 These Terms & Conditions shall be interpreted and governed by Irish law, and any disputes in relation to it are subject to the jurisdiction of the courts in Ireland.

6. REGISTERING WITH THE NATURAL MEDICINE COMPANY WEBSITE

In addition to the general browsing facility, The Natural Medicine Company offers both Consumers and Trade Customers the opportunity to register with the website.

Consumer who register with the Website may elect to avail of any of the following additional functionality, subject to the additional terms and conditions specified in the registration process:

• Register as a Purchasing Consumer , in which case the Product Window on the Master Toolbar will convert to a shop allowing you to purchase products, instead of just viewing them; this will require your opening an account and providing additional information (see 6.2 );
• Receive information periodically from The Natural Medicine Company Limited;
• Register as a Privileged User, in which case you will have access to additional information on traditional use and scientific research that is not generally available on the website (6.2).

Existing Trade Customers of the Natural Medicine Company need to formally register in order to gain access to the wide range of facilities available through the Trade Counter (6.3).

6.2.1 How to Apply
You may apply to register as a Consumer on The Natural Medicine Company website by clicking on the Create an account option at the top right hand corner of the home page.

You are required to enter your name and to provide your email address as a unique identifier. And you will be asked to enter your full postal address. Please ensure the information is correct as we cannot be held responsible for any deliveries or communications being dispatched to an incorrect address. All sections marked with a star must be completed, any without are optional.

Then select which of the 2 additional consumer functions you wish to apply for:

• elect to receive certain e-mail information ;
• access to certain privileged information not generally available on the website. (You will need to read and agree to the terms of this privileged information access)

By completing the steps, you will be deemed to have made an application and your registration will be processed.

• Purchasing Consumer Registration (only available to persons with an address in Ireland)

If you have applied to become a Purchasing Consumer, you will be asked to confirm that you have read and understood the Terms & Conditions governing the use of the website, with particular reference to Section 7, governing the supply and purchase of goods, and that you agree to be bound by same.

If you tick the box and hit the Confirm Icon, you will have been deemed to have accepted the terms and will be registered as a Purchasing Consumer. The Products Window will convert to a Shop with Shopping basket and associated functionality. N.B. the first time that you conduct a purchase you will still have to register your payment details and authorisations.

• Register to Receive E-Mails.

If you have applied to receive e-mails from The Natural Medicine Company Limited, you will be asked to confirm that you have read and understood the Terms & Conditions governing the use of the website, with particular reference to Section 8, governing making contact with you by e-mail.

If you tick the box and hit the Confirm Icon, you will have been deemed to have accepted the terms and conditions and will be registered to receive e-mails.

• Register as a Privileged User

The general product information available on The Natural Medicine Company Limited Website is strictly limited to what is contained on the product packs, or otherwise permitted under EU and national regulations. This information generally consists of statutory information on the content and use of a product, and indications for use authorised in accordance with prevailing scientific opinions. If you wish to obtain additional information on the traditional use of the product or its ingredients, or on developing scientific research relevant to certain products, you must register as a Privileged member of the Natural Medicine Company website. As part of the registration process you will be required to read and confirm you understand the Privileged Member Terms and Conditions (section 9) and that you agree to be bound by these. Note that Privileged Membership entitles you to no rights other than access to the additional information specified and that the granting or revoking of such membership is entirely at the discretion of The Natural Medicine Company Limited.

If you tick the box and hit the Confirm Icon, you will have been deemed to have read, understood and accepted the terms and conditions, and to have made application to the Company.

7. SUPPLY OF GOODS 

7.1 Purchasing 
If you have registered as a Purchasing Consumer, you may place an order to purchase a Product advertised for sale on the Site by following the onscreen prompts after clicking on the item you are interested in. You will have an opportunity to check and correct any input errors in your order by going to “View Basket” up until the point at which you submit your order by clicking the “Go to Checkout”.

7.1.1 After placing an order, you will receive an e-mail from us acknowledging that we have received your order, giving an order number and a summary of your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the Dispatch Confirmation). The contract between us will only be formed when we send you the Dispatch Confirmation.
7.1.2 The Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products, which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.
7.1.3 We may choose not to accept your order for any reason and we will not be liable to you or to anyone else in those circumstances.
7.1.4 We may be unable to process your order if: 
· a) the Product you ordered is out of stock or discontinued; or 
· b) there is a problem with authorisation of the payment on your credit card. 


7.2 Delivery 

We currently use An Post and both Nightline and Fastway courier services.

We aim to have a 24 hour turnaround on your order dispatch. Our courier service aims to deliver your package within 1-2 business days.

• Orders under €30 have a delivery charge of €6.00
• Orders over €30 have free delivery

Please note for Trade customer orders:

• Orders under €200 have a delivery charge of €6.00
• Orders over €200 have free delivery

7.2.1 We will deliver directly to the delivery address in Ireland (Republic of and Northern) specified in your order. 
7.2.2 We cannot guarantee to deliver all items ordered in one delivery if Products become out of stock during the order process.

7.3 Risk and Ownership 
Once delivered, the Products ordered will become your responsibility and, except in relation to Products that are damaged or faulty when delivered or have been incorrectly delivered, we will not accept any liability for their loss, damage or destruction after they have been delivered.
7.3.1 Ownership of the Products will only pass to you on: delivery of the Products to you; or us receiving full payment of all sums due in respect of the Products, (including delivery charges) whichever is the later.


7.4. Price and Payment 
The price of any Products will be as quoted on our Site, except in cases of obvious error.
7.4.1 These prices include VAT but exclude delivery costs, which will be added to the total amount due.
7.4.2 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
7.4.3 We cannot complete your order until you have paid for it in full. Payment can be made by most major credit or debit cards, by completing the relevant details on the “Order Summary” page.
7.4.4 By using a credit/debit card to pay for your order, you confirm that the card being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.
7.4.5 Our Site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our Site may be incorrectly priced. We will rectify any such errors as soon as possible once we become aware of them. If a Product's correct price is different from the price stated on our Site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection. 

7.5. Cancellation, returns and refund policy 
Except in relation to the Products specified in the next paragraph, you may cancel your order (or any part of it) at any stage before the Products are delivered to you, and up to 7 days afterwards. You may do so by simply returning the Products in accordance with the provisions below or by contacting our Customer Services team at sales@naturalmedicine.ie or on 045 865575
7.5.1 Where you decide to cancel an order after we have despatched the Products, you will be under a duty to return them to us, at your own risk and cost. All such Products should be returned within 7 days after the Products have been delivered to you. Until such time as they are returned, you must retain possession of the Products and take reasonable care of them. You should return the Products to us unused, and in the same condition in which you received them together with the original Product packaging, by one of the means set out in our Returns Procedure.
7.5.2 After you cancel your order and return the Products, any sum debited by us to your credit/debit card will be refunded in full. We will notify you of your refund via e-mail within a reasonable period of time. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. Refunds for Products purchased as gifts can only be given to the credit/debit card of the person who placed the order. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of you cancelling your order.
7.5.3 If any Product you purchase is damaged, faulty or incorrect, when delivered to you we may offer an exchange or refund as appropriate, in accordance with your legal rights. If you believe a Product is faulty, you should return the Product to us in accordance with the Returns Procedure. If you have any questions regarding returns, please Contact Us.
7.5.4 Our policy on cancellations, returns and refunds does not affect your statutory legal rights.

8 RECEIVING INFORMATION BY E-MAIL OR POST

If you have requested the option to receive news and offers by post or email, your name will be placed on our mailing list*. 

* Note: There may be some instances where you will receive a mailing or email automatically eg price increase notification. Once you receive the first mailing or e-mailer you can opt out of receiving such communications again.

8.1 Opt out of mailings – once you receive a mailing please call 045 865575 and ask to be removed from the mailing list. Our Customer Services Team will ask for your name and address and then block any further mailings for you.
8.2 Opt out of E-mailers – at the bottom of each e-mailer is an ‘unsubscribe’ button for you to click. Please follow the instructions and your details will be blocked from any further e-mailers.

 

9. PRIVILEGED USER REGISTRATION

By registering as a Privileged User of The Natural Medicine Company limited website you are requesting that the Company provide you with access to certain additional information on products and substances that is not automatically available on the website, so that you can make informed judgements as to the potential use of these products and substances.

9.1 The additional information supplied relates to:

• Traditional use;
• Emerging scientific research;
• Use in contemporary clinical practice.

9.2 In requesting access to this information, you acknowledge that the information provided is by its nature not scientifically proven, and that alone or in itself it may give an unbalanced of incomplete picture. Furthermore, you accept that the information is provided to allow you to gain a more complete understanding of the current state of knowledge in respect of the subject matter and not by way of recommendation for use.
